eviction LANDLORD / TENANT matters

Whether you are a landlord or tenant, the Law Firm of Phillip Gilbert, PLLC can assist you with representation on your Eviction matter.   If you are facing a dispute that cannot be resolved, we are here to help.  Our Firm has represented both landlords and tenants for many years in disputes and are prepared to fight for your rights, whether it involves negotiating a resolution with the other party or taking your case to court.

Landlords:   Our Firm will evaluate which pre-petition eviction notices are required for your eviction within the State of Texas.  While the notice period passes, our Firm will work with you to gather and identify all evidence needed to support your legal claims, draft all necessary pleadings, obtain sufficient service of process on your tenants and secure the earliest possible trial date for you.

Tenants:   Our Firm will ensure that your Tenant rights are followed pursuant to the  contractual  agreement with your landlord.  Tenants have rights, such as:

  • Repairs: landlords must make repairs within a reasonable amount of time after being alerted of the issue in order to protect a tenant’s safety and health.
  • Safety Issues: landlords must provide property security, such as deadbolts on doors and window latches, to ensure a safe home.
  • Quiet Enjoyment: tenants have the right to live in peace and quiet, and a landlord cannot disturb this right by unauthorized entry without proper notice.
